TERMS AND CONDITIONS
The language of the Terms and Conditions is English.
These Terms and Conditions shall apply to sales of Goods by the Seller to the Buyer to the exclusion of all other terms and conditions referred to, offered or relied on by the Buyer whether in negotiation or at any stage in the dealings between the parties, including any standard or printed terms tendered by the Buyer, unless the Buyer specifically states in writing, separately from such terms, that it wishes such terms to apply and this has been acknowledged by the Seller in writing.
Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.
The following terms and conditions are valid between you and Creator Projects and apply to all use of and orders placed on Creator Projects website creatorprojects.com. Pre-order items are stocks which are not on hand and therefore, have to wait till the products are produced and ready for shipping. Before ordering, please read the terms and conditions below.
PRE-ORDER RESERVATION
Pre-orders require payment to be made at checkout. It is possible to pre-order a maximum of two products per person. When placing a pre-order for our product, you will be required to provide certain information, such as your address and other billing information. You represent and warrant that all such information is accurate, and you shall ensure that such information is kept current.
Creator Projects shall have no responsibility or liability for inaccurate information or information that later becomes outdated, and shall have no obligation to make efforts to determine the correct contact or shipping information.
You acknowledge and agree that Creator Projects may decline or delay reservations to avoid oversubscription or as it deems appropriate, we will make efforts to inform you within two weeks of our receipt of your pre-order, and that you will be entitled to a full refund of the purchase price.
PRICE & PAYMENT
You will be charged the full price of the products at the time of placing the pre-order.
Methods of payment accepted are Credit Card Payment (Visa, Visa Electron, MasterCard). The purchase price does not include import duties, taxes, transfer fees, and other governmental charges, which are Buyer’s responsibility. The price does include VAT in accordance to the general rights of VAT in Denmark.
PRIORITY
With this Pre-sale, Creator Projects aims to receive economical security to produce products according to the order in which the pre-order is received which contains a box of 12 non-revealed art pieces by the 12 artists mentioned in the product description. If you cancel or forfeit your reservation in accordance with the terms, your position will be taken by the next person on the product reservation list.
DELIVERY SCHEDULE
Although we will make efforts to begin delivering products in May 2021, you understand and agree that there may be delays. Please do not order if you are unable to wait. An estimated time of delivery is only an estimate, is subject to change, and Creator Projects does not represent or warrant that it will be able to ship the Product by the estimated date. As a result, in the event that a delay arises and the estimated shipment is not met, Creator Projects is not responsible for any damages that may occur due to the delay, nor shall it be obligated, except as set forth in these terms, to provide any discounts, refunds or credits due to any such delays. We will provide you updates with respect to such delivery schedule. If for any reason you decide that you do not wish to continue to wait for your product, you may cancel your reservation as provided for in the cancellation section below.
RETURNS
All goods are sold on a firm sale basis, i.e. the Seller will not take back any goods not required or sold by the Buyer, unless otherwise agreed, in which case the following terms apply. Any returns must be authorized by a representative of the Seller before any credit will be given. Where the Seller agrees to accept the return of goods that are not damaged the Buyer will be responsible for the cost of carriage and will ensure that they are carefully packaged to avoid any damage in transit. The Seller will not be obliged to accept any goods that are damaged in any way. Credit of amounts due or paid in will only be given for goods that are in saleable condition.
WARRANTY
Seller warrants that Goods sold hereunder meet their descriptions or specifications, subject to use, storage and application thereof in accordance with and based on Seller’s standard tolerances, instructions of use and recommendations.
Unless otherwise restricted by mandatory applicable law, the warranty set forth herein is expressly in lieu of all other warranties, whether expressed or implied, including, without limitation, any and all warranties of merchantability, quality and fitness for use and for purpose, any advice and recommendation and any obligations or liabilities which may be imputed to seller, any and all of which are hereby expressly disclaimed, denied and excluded. Buyer expressly agrees that no warranty that is not specifically stated in this agreement will be claimed or otherwise adhered to by buyer and/or by anyone acting on buyer’s behalf and/or by anyone deriving the legality of its claim from buyer, nor that will any such warranty be valid. Seller neither assumes nor authorizes any other person to assume for it, any other liability in connection with the sale, use or handling of any and all goods specified or contemplated by this contract. No warranty is made with respect to any of these goods which have been subject to accident, negligence, alteration, improper care, improper storage, improper maintenance, abuse or misuse.
CANCELLATION
Buyer or seller may cancel this reservation by terminating the pre-order at any time for any or no reason prior to our notice to you that your product is ready for delivery. If you do so prior to our notice of delivery, you will obtain a refund of the purchase price without interest. If Creator Projects cancels your reservation you will receive a full refund of the purchase price without interest.
LIMITATION OF LIABILITY
Under no circumstances will Creator Projects be held liable for any incidental, special or consequential damages arising out or related to this agreement. In the event that Creator Projects is held liable for any damages arising out or related to these terms, your sole and exclusive remedy will be the full refund of your purchase price without interest.
CUSTOMER INFORMATION
Creator Projects is collecting information about you when you are actively filling in details on www.creatorprojects.com. We collect and store name, e-mail address, address and other information to deliver our service and purchase to you. The information is used only for the purpose of completing a purchase.
The data we collect from you is stored within the European Economic Area (“EEA”). For transfers outside the EEA, Creator Projects will use Standard Contractual Clauses and Privacy Shield as safeguards for countries without adequacy decision from the European Commission. All Personal Information will be deleted one month after your purchase is shipped.
CHANGE TO THE TERMS
Creator Projects reserves the right to revise the Terms and Conditions at any time. The date of the latest update is found underneath. Users are responsible for keeping themselves updated with such changes. Please note that the terms and conditions valid for your order is always the terms and conditions that is in effect as of the time that you place your order and not a later version. You should keep a copy of these Terms and Conditions for future reference.
